1.INTRODUCTION

1.1. Gauja National Park Tourism Association Enter Gauja (hereinafter: Enter Gauja), with registration no. 40008050743, address Ausekļa Street 6, Sigulda LV – 2150, is the manager of the online store (shop.entergauja.com; hereinafter: the Online Store).

1.2. These terms and conditions apply to all purchases of goods when ordering online, by phone or e-mail. Before ordering the product, read the Terms of Use and Privacy. By placing an order, the customer confirms that he has read, understood and agrees to the Terms of Use.

1.3. The Terms of Use regulate the legal relationship between the Buyer and the Gauja National Park Tourism Association Enter Gauja.

2. GENERAL 

2.1. When purchasing goods in the Online Store, a distance agreement (hereinafter – Distance Agreement) is concluded between the Buyer and the Online Store.

2.2. The distance agreement is concluded and enters into force when the Buyer has placed the Order in the Online Store and the Seller has sent a confirmation and / or Advance invoice to the e-mail specified by the Buyer.

2.3. The Seller is entitled to unilaterally amend, update and supplement the terms of the Distance Agreement at any time, without notice. When shopping in the Online Store, the Buyer is subject to the provisions of the Distance Agreement that are valid at the time of ordering the Goods, therefore the Buyer must get acquainted with the provisions of the Distance Agreement each time the Order is placed.

2.4. The Buyer is informed about the changes in the online store shop.enetrgauja.com or by e-mail.

3. REGISTRATION

3.1. The buyer has the right to choose and purchase goods in the online store shop.entergauja.com both as a Registered customer and without registering.

3.2. When purchasing the Product in the Online Store, there is offered to register by filling in the registration form. The information provided in the registration form is also stored and used for future purchases by the Buyer. You can also sign up using a Facebook or Google account.

3.3. Buyers who do not wish to register are offered to complete the Purchase by providing the Seller only with Delivery Information and other information necessary for order processing and delivery.

3.4. The Buyer is responsible for ensuring that all data provided is true and complete. If the data of the Registered Customer changes, the Buyer must update them before placing the order. The Seller is not liable for losses incurred by the Buyer or third parties in case the Buyer has provided incorrect or incomplete data.

3.5. The Registered Customer undertakes not to disclose access data to Third Parties. The registered customer is responsible for the storage of access data, as well as for any activity performed in the online store using his access data. Any person who joins the Online Store and places an Order using the Registered Customer’s access data is considered by the Seller to be a Registered Customer.

4. PRODUCT AND PRICE

4.1. The images are for information only. The Products shown in the pictures in the online store may differ from the products in real in terms of their color, size, shape or other parameters in nature.

4.2. All prices for the Goods in the Online Store are presented in euros, including VAT. Costs for delivery of the Goods to the Buyer are not included in the price of the goods.

4.3. Delivery fee (if any) is indicated separately before payment of the order.

4.4. Enter Gauja reserves the right to unilaterally change the offer of goods, prices, as well as apply discounts to the goods without prior notice. The Goods are sold at the prices valid at the time of ordering, except in cases when the Product has an incorrect price due to a technical error or system damage.

4.5. In an emergency situation, when after the order is placed due to unforeseen circumstances, Enter Gauja cannot ensure the delivery of the purchased Product, Enter Gauja undertakes to offer a similar product. If the ordered Product is replaced with another product, the price of which is lower than the ordered Product, Enter Gauja returns the difference to the Buyer’s bank account within 14 working days. In case the price of the Product is higher, the Buyer is obliged to make a surcharge in the amount of the missing amount.

4.6. Enter Gauja has the right to refuse to sell the Goods ordered in the online store, informing the Customer thereof, if the Product is no longer available, as well as in cases where the Agreement is concluded by a person who does not have such rights under this Regulation.

4.7. In case Enter Gauja does not fulfill the Buyer’s order, the money is returned to the Buyer within 14 working days.

5. PAYMENT OPTIONS

5.1. You can pay for the order in the Online Store in the ways specified in the E-environment or by paying the Advance invoice sent electronically by the Seller. The cost of the order may include the cost of the service in accordance with the agreement concluded between the Buyer and the bank or credit card issuer.

5.2. All refunds made by Enter Gauja are transferred via a bank account.

5.3. The customer’s order and invoice are canceled if no payment is received within 7 days after the invoice is issued.

6. DELIVERY AND TRANSFER OF GOODS

6.1. Delivery of the order is made only in the ways specified in the Online Store (DPD courier and Omniva parcel terminals).

6.2. The buyer is obliged to check the correctness of the contact information before placing the order in order to avoid delays and misunderstandings when delivering the goods. Enter Gauja is not responsible for any delays or misunderstandings in the delivery of goods, if the delay or misunderstanding is due to inaccurate or incorrect information provided by the Buyer in the order form.

6.3. The risk of damage or loss of the product is transferred to the Buyer upon receipt of the order.

6.4. Upon receipt of the Goods, the Buyer or his representative checks the conformity of the Goods to the ordered one and in case of non-conformity of the Goods, the Buyer shall immediately contact Enter Gauja.

6.5. The delivery time of the order depends on the location of the products, the delivery address and the availability of the product. The maximum delivery time for products in stock is 15 days.

6.6. Enter Gauja undertakes to deliver the Goods to the Buyer within the term specified in the product information. These terms do not apply if the Product is not available and the Customer is informed about the absence of the ordered goods.
The buyer is also aware that in exceptional cases (Force majeure) the delivery of goods may be delayed.

6.7. From the moment the order is handed over to the Courier, the courier company is responsible for the delivery of the shipment. At the time of delivery, the Buyer is obliged to review the condition of the shipment with the Seller or his authorized representative. If the Buyer signs the receipt documents (delivery notes), the package is considered to be in proper condition.

7. RIGHT OF WITHDRAWAL

7.1. If the Customer is a consumer within the meaning of the Consumer Rights Protection Law, within 14 calendar days from the moment of delivery of the product (s), the Customer may withdraw from the purchase agreement by submitting an application to Enter Gauja for sending the right of withdrawal to info@entergauja.com. Indicating in the application the invoice number and the name of the product, which the Buyer wishes to refuse.

7.2. The Buyer must fill in and sign the Withdrawal Form attached to the delivery document (also available here Atteikuma tiesību veidlapa ), indicating all the necessary data. A withdrawal form may also be submitted with the Product.

7.3. After sending the application for the exercise of the right of withdrawal, the Buyer delivers the Product to the Enter Gauja office (Lielā Street 30, Ieriķi, Drabešu Parish, Amatas District, LV-4139) not later than within 14 days. The direct cost of returning the goods is covered by the Buyer. Entergauja is not responsible if the product is broken and damaged due to the Buyer’s fault. If the Buyer exercises the right of withdrawal and the Product is delivered to the Enter Gauja office unused and undamaged within 14 days of receipt, Enter Gauja undertakes to make a refund and the bank account specified by the customer within 14 days.

7.4. In case the condition of the returned goods is damaged, which has occurred as a result of improper use, unpacking the Goods and checking their functions, the Buyer is obliged to compensate the incurred losses.

7.5. The Buyer is responsible for maintaining the quality and safety of the Product during the period of exercising the right of withdrawal. The Buyer shall be liable for any decrease in the value of the Product if the Product has been used in a manner incompatible with the principle of good faith, including used for a purpose other than to ascertain the nature or operation of the Product.

7.6. The Seller has the right not to accept the Product and to refuse the Buyer to exercise the right of withdrawal, as well as not to refund the money paid by the Buyer for the Product in accordance with the Cabinet of Ministers Regulation No. 255 in the cases specified in Paragraph 22, including:

  • The product is worn and / or damaged;
  • The product is not complete or is not in the original packaging, or its packaging is significantly damaged (unless it is impossible for the consumer to open the packaging without damaging it) in order to protect the product from damage or deterioration.

7.7. The goods must be undamaged, have not lost their appearance (labels have not been removed or damaged, protective films have not been torn off, etc.) and have not been used. The product must be returned in its original packaging, in the same set as it was received, definitely returning the product purchase document, warranty card (coupon) (if any), instructions for use and other accessories of the product.

7.8. The Buyer cannot exercise the right of withdrawal if the Goods are delivered, which are manufactured according to the consumer’s instructions and in other cases provided for in regulatory enactments (see Consumer Rights Protection Law http: //likumi.lv/doc.php? 8. GOODS WHICH DO NOT COMPLY WITH THE PROVISIONS OF THE AGREEMENT

8.1. The Buyer (consumer) submits the application for the non-compliant product, as well as the non-compliant Product itself to the Seller in a free form, indicating his name, surname, residential address and contact information, as well as provides a description of the non-conformity and attaches copies of transaction documents. other documents substantiating the application (if possible). The Buyer (consumer) shall submit such Application to the Seller in person at the Enter Gauja office, address: Lielā iela 30, Ieriķi, Drabešu pagasts, Amatas novads, LV-4139, informing about his arrival in advance. The application will be reviewed in accordance with the procedures and terms specified in the Consumer Rights Protection Law.

8.2. Enter Gauja is not responsible for the non-compliance of the Goods with the provisions of the contract resulting from the Buyer’s actions and / or omissions, including improper use or improper storage of the Goods (non-compliance with storage conditions).

8.3. In case the Buyer does not agree with the solution offered by Enter Gauja, the Buyer who is a consumer within the meaning of the Consumer Rights Protection Law has the opportunity to exercise and protect his in accordance with the procedures specified in the Defense Law and related regulatory enactments.

8.4. The product has a 2-year warranty, in accordance with the Consumer Rights Protection Law.

9. RESPONSIBILITY

9.1. The relationship between the Buyer and Enter Gauja is regulated by these Terms of Use, as well as the legislation of the Republic of Latvia. In the event of damage, the guilty party compensates the other party for the direct damage.

9.2. The buyer is fully responsible for the accuracy of the data provided in the registration form. If the Buyer has provided inaccurate or incorrect data in the registration form, Enter Gauja is not responsible for the incorrectness of the data and the consequences thereof and is entitled to claim compensation for direct losses from the Buyer.

10. PRIVACY POLICY

10.1. The Buyer’s personal data will be used to identify the Buyer and receive the order, process the order and make the delivery, prepare accounting documents, including the invoice, refund the overpaid amount and return the returned products, administer financial obligations and other obligations arising from these Terms of Use and distance contract.

10.2. Enter Gauja stores the Buyer’s data for an indefinite period of time or until the Buyer requests the deletion of the collected data.

10.3. Data exchange between the Buyer, banks and the card payment center is encrypted, which ensures the security of the Buyer’s personal data and bank data. The payment is made outside the Internet store environment, in a secure payment environment at the respective bank or at the service provider. Information about the Buyer’s bank details and credit card information is not available in the online store.

10.4. The personal data provided by the Buyer is processed in compliance with the requirements specified in the Personal Data Protection Law and other legal acts of the Republic of Latvia, which regulate the processing and protection of personal data.

10.5. The personal data to be processed is the data that Enter Gauja requires from the Buyer when registering an account and / or placing an order (name, surname, address, telephone number, e-mail address, current account number, shopping cart contents and purchase history). This data is processed for the fulfillment of the Buyer’s orders (including the sending of messages related to the order), payment, delivery of goods and preparation of personal offers.

10.6. The Gauja National Park Tourism Association Enter Gauja, registration No. 40008050743, address Ausekļa Street 6, Sigulda LV – 2150 is responsible for the processing of the Buyer’s data.

10.7. Enter Gauja undertakes not to disclose the Buyer’s personal data to third parties, except in cases:

  • To the courier service provider, to the extent necessary for the delivery of the Goods to the Buyer;
  • For partners who ensure the delivery of the Goods to the Buyer or provide other services related to the execution of orders (name, address and telephone number).
  • The customer’s personal data is processed only for the purpose of fulfilling the order, and authorized partners ensure the same level of personal data protection as Enter Gauja.

10.8. The buyer has the right to review his personal data at any time and request the correction or deletion of this data, unless otherwise provided by law.

10.9. If the Buyer has expressed interest in receiving Enter Gauja news and / or personal offers, the Buyer is entitled to cancel them by sending the relevant message to Enter Gauja to the e-mail info@entergauja.com or by clicking on the relevant link in each offer e-mail.
